Terms and Conditions of Sale

1. Seller identity
The maisonmilayaparis.com website is operated under the trading name Maison Milaya Paris.
2. Purpose and scope
These Terms and Conditions of Sale govern distance sales of products concluded between Maison Milaya Paris and any consumer making a purchase on the maisonmilayaparis.com website.
Before placing an order, the customer may view, download and save these Terms and Conditions of Sale. Confirming the order constitutes acceptance of the version applicable on the date of purchase, without depriving the customer of mandatory rights provided by law.
3. Products
The essential characteristics of each product are set out on its product page. The customer must review them before ordering, particularly the dimensions, materials, colours, variants, parcel contents and any specific conditions of use or care.
Photographs are presented with the utmost care. However, colour rendering may vary slightly depending on the screen used. A natural variation in shade, veining or texture inherent to a material does not necessarily constitute a defect.
Offers are valid while stocks last. If a product becomes unavailable after an order has been placed, the customer will be informed promptly and the corresponding amounts refunded.
4. Prices
The applicable prices are those displayed when the order is confirmed. For sales in France, they are shown in euros and include all taxes where VAT applies. Delivery charges and any additional costs are presented before the order is finally confirmed.
A subsequent price change does not apply to orders that have already been confirmed. In the event of an obvious pricing error that the customer could not reasonably have failed to notice, Maison Milaya Paris will contact the customer and offer either to confirm the order at the correct price or to cancel it with a full refund.
5. Order
The customer selects the desired products and variants, checks the basket, enters their contact details and chooses from the delivery and payment methods offered. The customer is responsible for checking that the information is accurate before confirming the order with an obligation to pay.
The order is confirmed by email after payment has been accepted. Maison Milaya Paris may refuse an order for a legitimate reason, including proven or suspected fraud based on objective evidence, inability to take payment, product unavailability or a previous unresolved payment dispute.
6. Payment
Payment is due when the order is placed and is made using the solutions offered at checkout. Transactions are processed by the payment providers identified to the customer. Maison Milaya Paris does not retain full banking details.
7. Delivery
The available delivery areas, methods, charges and times are stated before the order is confirmed. The date or timeframe announced when the order is placed constitutes the applicable commitment. If no specific indication is provided, delivery will take place no later than 30 days after the contract is concluded.
The customer must provide a complete and accessible address. In the event of an address error or inability to deliver attributable to the customer, the cost of reshipment may be charged after prior notice.
The risk of loss or damage passes to the customer when the customer, or a third party appointed by the customer other than the carrier offered by Maison Milaya Paris, takes physical possession of the product.
In the event of a delay, the customer has the remedies provided by the French Consumer Code. A delay does not automatically terminate the contract where the law first requires a request for delivery within a reasonable additional period.
8. Receipt, damage or apparent non-conformity
The customer is advised to check the condition of the parcel and product upon delivery and to report any damage promptly to y.contactshops@gmail.com, attaching photographs of the product, packaging and shipping label where possible.
This recommendation helps us process the matter, but failure to report it within 48 hours does not deprive the customer of their statutory rights, particularly under the statutory warranty of conformity.
9. Right of withdrawal
The consumer has 14 days from receipt of the goods to give notice of their decision to withdraw, without having to give a reason. Where several goods from the same order are delivered separately, the period runs from receipt of the last item.
The full procedure, model form, coverage of the direct return costs and statutory exceptions are detailed in the Returns and Refunds Policy, which forms an integral part of these Terms and Conditions of Sale.
10. Returns and refunds
After giving notice of withdrawal, the customer returns the goods within 14 days in accordance with the instructions provided by customer service. For every valid return request made on or after 27 August 2026, Maison Milaya Paris covers the direct return costs for all products, including bulky items, from every country we deliver to, using the return method arranged by our customer service team.
The goods must be returned complete. The customer may handle them to the extent necessary to establish their nature, characteristics and proper functioning. An amount corresponding to an actual loss in value may be deducted if the goods have been handled beyond what was necessary.
The refund is made using the same payment method, unless the customer expressly agrees to another method at no cost. It may be deferred until the goods are recovered or proof of dispatch is received, whichever occurs first.
11. Statutory warranties
Maison Milaya Paris is liable for lack of conformity under the conditions set out in Articles L. 217-1 to L. 217-32 of the French Consumer Code and for hidden defects under the conditions set out in Articles 1641 to 1649 of the French Civil Code.
Statutory warranties notice
The consumer has two years from delivery of the goods to invoke the statutory warranty of conformity where a lack of conformity arises.
This warranty entitles the consumer to repair or replacement of the goods within a maximum period of 30 days after the request, free of charge and without major inconvenience. If the goods are repaired, the original warranty is extended by six months. If the consumer requests a repair but the seller requires a replacement, the warranty is renewed for two years from the date of replacement.
The consumer may obtain a price reduction while keeping the goods or terminate the contract and return the goods where repair or replacement is refused, takes place after the statutory period, causes major inconvenience, or where the defect persists despite an attempt to bring the goods into conformity. The consumer may act immediately where the defect is sufficiently serious.
Any period during which the goods are out of use for repair or replacement suspends the remaining warranty period.
The consumer also benefits from the warranty against hidden defects for two years from discovery of the defect. The consumer may request a price reduction if they keep the goods or a full refund in exchange for returning them.
These warranties are mandatory and free of charge. They apply independently of any commercial warranty that may be offered. The seller providing the warranties is Maison Milaya Paris, which can be contacted at y.contactshops@gmail.com.
12. Liability and force majeure
Maison Milaya Paris is responsible for proper performance of the obligations arising from the contract, subject to the grounds for exemption provided by law. No provision of these Terms and Conditions of Sale limits the consumer’s statutory rights or any liability that cannot lawfully be excluded.
A party is not liable for a failure caused by an event that meets the statutory criteria for force majeure. The party concerned informs the other party as soon as possible and resumes performance of its obligations as soon as the impediment ceases.
13. Personal data
Personal data required to process orders, payments, deliveries and customer service requests is processed in accordance with the Privacy Policy. It sets out the purposes, legal bases, retention periods, recipients and arrangements for exercising rights.
14. Intellectual property
Site content, including text, photographs, visuals, graphics and distinctive signs, is protected by applicable intellectual property rights. Any unauthorised reproduction or use is prohibited, subject to the exceptions provided by law.
15. Customer service and complaints
For any question or complaint, the customer may contact Maison Milaya Paris at y.contactshops@gmail.com or via the contact page. To help us process the matter, the customer is advised to provide the order number and attach any relevant supporting evidence.
16. Consumer mediation
After first submitting a written complaint that has not produced a satisfactory solution, the consumer may use the consumer mediator responsible for Maison Milaya Paris free of charge.
The mediation service is in the process of being appointed, and its contact details will be published before the site’s final commercial launch.
17. Governing law and dispute resolution
These Terms and Conditions of Sale are governed by French law, without depriving consumers residing in another country of any more protective mandatory provisions that may apply to them in their country of residence.
In the event of a dispute, an amicable solution will be sought first. Failing this, the consumer may bring the matter before the competent court in accordance with applicable legal rules.
